Dependant upon the circumstances of course. If you are not at fault then you won't be penalised. If you are at fault you can still be charged and convicted of careless driving, dangerous driving or even causing death by dangerous driving.

The current government is trying to reduce the speed limit for rural single carriage roads to 50mph. Regardless of the enforceable limit, the onus is on YOU to take responsibility and drive according to the road conditions at that time. That has nothing to do with the speed limit.

I was nearly killed by someone who had had 3 pints and decided to drive home. He failed to stop at a junction and I didn;t even have time to get my foot on the brakes before I slammed into him. He had no passengers. DOes that make it acceptable that he nearly killed me and my two passengers?
